Terms
The deal, in plain words.
These terms cover the songs and videos we make for you, and this website. The form on our site is only a request: our agreement for your song is the written order we both sign, together with these terms. Where the order and these terms differ, the order wins.
Updated October 14, 2026.
Who we are
Explainer Music Videos is run by Avery Intelligence Inc, a Delaware corporation at 1300 El Camino Real, Suite 100 #66, Menlo Park, CA 94025. “We” means Avery Intelligence Inc. “You” means the business that orders from us.
We work only with businesses. You’re ordering for a business, not for personal use, and whoever signs for it is 18 or older and may sign for it.
What we make
A song written for your business, and a video to go with it, in the package you pick:
- The Jingle, $750: a 30-second song and video.
- The Story Song, $1,950: a 2-minute song and video, and everything in The Jingle.
- The Milestone, $3,900: a 4-minute song and video, and everything in The Story Song.
What each package includes is listed on our pricing and written into your order. Prices are fixed and in US dollars, plus sales tax where it applies.
How it works
- You send us your website or Facebook page, your logo, and anything you’d like in it, and we talk for about half an hour.
- We write the lyrics. You okay every word before we make anything.
- We make the song and the video, and show you a preview. Previews may carry a watermark.
- Two rounds of changes are included. A round is one list of changes, sent together. Anything beyond that, or a new idea after you’ve approved, we quote before we start.
- It takes about seven days from our call to your finished video, longer while we wait for your answers. A date we give you is our aim, not a guarantee.
Paying
You don’t pay until you’ve seen the result. When you’re happy with it, we send you an invoice for the fixed price in your order, due within 7 days. Once it’s paid, we send you every file you ordered.
- If you don’t buy. Tell us and you owe nothing. The song and the video then stay with us, and you may not use them or the preview. We won’t use lyrics about your business for anyone else.
- If it goes quiet. If we don’t hear from you for 30 days, or an invoice isn’t paid within 30 days of the final preview, we close the order and you owe nothing.
- Fixes and refunds. Because you pay only after you’ve seen and approved the result, payments aren’t refunded. If a file we deliver doesn’t work, or isn’t what your order says, tell us within 30 days and we’ll fix it or refund you.
- Reversed payments. If a payment is reversed or charged back, your right to use the song and video stops until it’s paid.
Your song and video: what you get
In short: once you’ve paid, you can use your song and video anywhere, for as long as you like, and we’ll never sell them to anyone else. What we can’t give you is exclusive ownership. The details:
- Use it everywhere, for good. Once you’ve paid, you may use the song and the video anywhere in the world, in any medium, with no time limit and nothing more to pay us: Facebook, Instagram, TikTok, YouTube, your website, ads, local TV, radio, on-hold music and events. You may cut them, edit them and put them in your ads. We can’t take this right back, unless a payment is reversed and not made good.
- Made for you alone. We write each song for one business. We won’t sell, license or give your song, lyrics or video to anyone else, or make the same song for another business.
- Not exclusive ownership. We make the music with licensed software, and the company behind that software keeps a license to what it helps make. Copyright may also not protect every part of a song or video, in the United States or elsewhere. So your signed order transfers to you every right we hold, but we can’t promise that the song is yours alone, that you can register a copyright in it, or that you can stop someone else from using it or something like it.
- Don’t register it as yours alone. For the same reason, please don’t register the song with YouTube’s Content ID or a similar system, or claim it as your exclusive work with a music distributor or a royalty society. If a platform asks who owns it, tell us and we’ll help you answer.
- Leave the files as they are. The files we deliver may carry embedded information, such as metadata or an inaudible marker. Please don’t remove it, and don’t use the files to build or train other software.
- New, not a sound-alike. We write every song new for you. We don’t copy other songs, imitate a real singer’s voice, or put a famous tune in your song.
- If a platform flags the music. Sites like YouTube and Facebook scan videos for music automatically, and now and then flag a song by mistake. If that happens to yours, tell us and we’ll help you clear it.
- Your own material stays yours. What you send us, like your name, logo, photos, slogan or words of your own, stays yours. You let us use it only to make your song and video.
- Showing your video. We show your video as an example of our work only if you say yes.
What you promise us
- You have the right to everything you send us, and what you tell us about your business is true. You can back up every claim in your lyrics, such as prices, hours, “licensed” or “open 24/7”.
- Anyone shown in your photos, or named in your lyrics, has agreed to it. You won’t send us patient, health or other sensitive personal information.
- If your trade has advertising rules, such as a license number, a brokerage name or a required disclaimer, you tell us what your ads must say. Your order has a checklist for it.
- You’re responsible for how you use the finished video, such as the rules of the sites you advertise on, and you’ll follow the rules for the song above.
- If someone makes a claim against us because of what you sent us, or how you used the video, you’ll cover our reasonable costs.
What we won’t make
We write only what you confirm is true, and leave out anything we have reason to doubt. We don’t put promises in a song that you can’t keep, make claims about your competitors, or make anything unlawful, hateful or misleading. We may turn down any order, and then you owe nothing.
What we don’t promise, and limits
We make every video with care, but we can’t promise results. A song can help people remember you; we don’t promise more customers, calls or sales.
Apart from what these terms and your order promise, we provide our videos and this website as they are, without any other warranties, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
For any claim about an order, the most we can owe you is what you paid for that order, and neither of us owes the other lost profits or other indirect losses. None of this limits anything the law doesn’t allow to be limited.
This website
The films, songs, words and pictures on this site belong to us or to the businesses we made them for. Watch them and share links to them, but don’t copy them for your own use. Our privacy page says what we keep when you write to us or visit.
The fine print
- Your signed order and these terms are our whole agreement about your song and video.
- California law governs these terms. If we disagree, we’ll both try to settle it by email for 30 days first; after that, the state and federal courts in San Mateo County, California decide. Either of us may still take a claim to small claims court.
- Neither of us may hand this agreement to someone else without the other’s OK, except as part of selling the business.
- Neither of us is responsible for delays caused by things beyond our control, like storms, outages or illness.
- We work for you as an independent business, not as your employee or agent.
- Anything meant to last after the order, like your right to use the song, does.
- We may both sign and send notices electronically.
- We may update these terms. The version in force when you ordered applies to that order.
- If a court finds one part of these terms unenforceable, the rest still applies.
